Welcome to My Allied Circle. By accessing or using our platform at myalliedcircle.com.au, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our service.

My Allied Circle is operated by Melbourne Online (ABN 86 433 101 336).

1. Service Description

My Allied Circle is a care coordination platform that connects patients with their allied health providers (physiotherapists, psychologists, exercise physiologists, osteopaths, and others). The platform enables care teams to share treatment notes, coordinate care, and collaborate within secure care circles.

My Allied Circle is not a medical service. We do not provide medical advice, diagnosis, or treatment. The platform is a communication and coordination tool only. All clinical decisions remain the sole responsibility of the treating health professionals.

2. Eligibility

• You must be an Australian resident to use My Allied Circle.
• You must be at least 18 years of age, or have a parent or legal guardian create and manage an account on your behalf.
• By creating an account, you confirm that all information you provide is accurate and complete.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and up-to-date information in your account profile.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
• If using the "Remember Me" feature, only do so on personal, private devices. Do not use it on shared or public computers.

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Harass, abuse, or threaten other users
• Upload spam, malicious content, or content that infringes on intellectual property rights
• Attempt to gain unauthorised access to other users' accounts or data
• Use the platform to store or transmit content unrelated to allied health care coordination
• Interfere with or disrupt the platform's infrastructure or security
• Share your account credentials with any other person

5. Subscription and Billing

For Patients

• Free trial: New patient accounts receive a 21-day free trial with full access to all features. No credit card is required during the trial.
• Subscription: After the trial period, continued access requires a subscription of $12 AUD per year (approximately $1 per month).
• Auto-renewal: Subscriptions automatically renew each year. You will receive a receipt by email for each payment.
• Cancellation: You can cancel your subscription at any time from the Billing page. You will retain access until the end of your current billing period.
• Payment processing: All payments are processed securely by Stripe. We do not store your credit card details.

For Providers

• Provider accounts are free. There are no fees, premium tiers, or limits on the number of patient circles a provider can join.

6. Intellectual Property

• The My Allied Circle platform, including its design, code, branding, and documentation, is the intellectual property of Melbourne Online.
• You may not copy, modify, distribute, or create derivative works based on the platform without our written consent.
• The My Allied Circle name, logo, and branding are trademarks of Melbourne Online.

7. Treatment Notes and User Content

• Ownership: You retain ownership of all content you create on the platform, including treatment notes, comments, and file attachments.
• Licence: By submitting content, you grant My Allied Circle a limited licence to store, display, and transmit that content to members of the relevant care circle, as necessary to provide the service.
• Visibility: Treatment notes are visible to the patient and all approved providers in that patient's circle. Patients control who is in their circle.
• Responsibility: Providers are responsible for the accuracy and appropriateness of the clinical content they enter. Patients are responsible for the content of any notes they add.

8. Disclaimer

My Allied Circle is not a substitute for professional medical advice, diagnosis, or treatment.

• We do not verify the qualifications or credentials of providers who register on the platform. Patients should independently verify their providers' qualifications.
• We are not responsible for the accuracy, completeness, or clinical appropriateness of treatment notes or information shared by users.
• We are not liable for any clinical decisions made by providers or patients based on information shared through the platform.
• The platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by Australian law:

• Melbourne Online's total liability to you for any claim arising from your use of My Allied Circle is limited to the amount you paid for the service in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or interruption of service.
• We are not liable for any loss or damage arising from unauthorised access to your account where you have failed to protect your login credentials.

10. Termination

• By you: You can delete your account at any time from the Manage Account page. This will permanently remove all your data including treatment notes, attachments, and provider connections.
• By us: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the platform in a way that harms other users or the service.
• Effect of termination: Upon termination, your right to use the platform ceases. If your account is terminated by us for a Terms violation, you are not entitled to a refund for any remaining subscription period.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria for the resolution of any disputes arising from these Terms or your use of the platform.

12. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify users via email and update the "Last Updated" date at the top of this page. Your continued use of the platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the service and delete your account.
